Deferred Prosecution: Mental Health as Primary Diagnosis
In the State of Washington most members of the legal community, health care professionals and alcohol and drug counselors are aware of the Deferred Prosecution option for people suffering from the disease of alcoholism or chemical dependency. However, for the individuals who are faced with similar legal consequences and suffer from a diagnosable mental health concern the option of the Deferred Prosecution is also a viable option.
… the petitioner shall allege under oath in the petition that the wrongful conduct charged is the result of or caused by alcoholism, drug addiction, or mental problems for which the person is in need of treatment and unless treated the probability of future recurrence is great, along with a statement that the person agrees to pay the cost of a diagnosis and treatment of the alleged problem or problems if financially able to do so. .. Mental Health Services at Associated Behavioral Health Care
Associated Behavioral Health takes an integrative approach to mental health assessments and treatment. This is based on an understanding of the roles that substance use can play in a prospective client’s mental health.
In general, our process works using a two pronged approach to treatment and diagnosis.
The entry point for clients for a mental health assessment often begins with an initial screening, assessment, and treatment recommendations.
The screening and assessment process is based upon best practices and is oriented towards diagnostic criteria as established by the DSM-IVTR. The DSM-IV is the primary instrument used for the assessment and diagnosis of mental health issues and is considered comprehensive by many medical and mental health providers.
Our assessment process recognizes the impact of psychosocial events and gathers the life history of the prospective client as well as diagnostic criteria. This leads to a more accurate evaluation of the client’s mental health and looks at how life circumstances, life experience, and family history affect a client’s perspective of themselves and the world.
The process of treatment planning and recommendations involves several possible outcomes. The primary treatment recommendations are designed to meet criteria for a mental health diversion if that is appropriate for the client and in the client’s best interests. (See above reference to the Deferred Prosecution*)
Treatment recommendations may include a chemical dependency evaluation by a Chemical Dependency Professional (CDP) and if substance abuse or dependence issues are identified appropriate treatment to treat the chemical issue. The results of this assessment are merged with the mental health assessment to form an integrative approach to treatment for the client.
Our approaches to psychotherapeutic intervention are integrative in nature and can include many modalities of treatment. This could include psychodynamic psychotherapy, systems interventions, and cognitive models of treatment.
Our goal at ABH is to provide a set of mental health services that are tailored to the client’s needs and represent the best practices in the industry for treatment of mental health, substance dependence, and co-occurring disorder patients.
* If a Petition for Deferred Prosecution is determined to be clinically appropriate and is approved by and requested by the attorney of the client. All documents provided to the client and attorney shall meet the court requirements for the Petition for Deferred Prosecution as outlined in the Washington Administrative Code (WAC).
